Terms of Use of the One2.one Online Community.

The ONE2.ONE internet platform is operated by SEITENSPIEL.AT | August Novy Str. 23 | 3100 St. Pölten - Austria.

The ONE2.ONE internet platform (hereafter referred to as COMMUNITY) offers its registered users (hereinafter referred to as users) the opportunity to publish their own texts, images and their own content. The users can publish their profile and their contents independently, for the provided contents they are alone responsible.

Each user agrees to observe the principles of the community and in particular to cease any content that is intentionally untrue and defamatory or meet other criminal offenses or violate the rights of third parties. Incidentally, the rules of conduct customary on the Internet must be observed and general manners must be observed. This applies in particular to the code of conduct described on ONE2.ONE.

It should be noted that the publication of content and opinions by users ofONE2.ONE in the community is not an expression of opinion of the ONE2.ONE internet platform or SIDE GAME.AT.

1. Scope

1.1 The following terms and conditions apply exclusively to the use of the comunity operated by SEITENSPIEL.AT via the website www.one2.one. Conflicting terms and conditions of the user expressly do not apply, unless SIDE GAME.AT expressly agrees to their validity in writing.

1.2 SEITENSPIEL.AT reserves the right to change these terms and conditions with effect for the future, provided the changes are reasonable for users of the community taking into account the interests of SEITENSPIEL.AT. This is especially the case if the changes are without economic disadvantages for the users, e.g. Changes in the registration process or adaptation of the GTC under consideration of modified or new services or functionalities.

1.3 In the event of the change, SITE GAME.AT informs the user of the changes to the GTC by e-mail and informs him that the changes are considered accepted if he does not object within four weeks of receipt of the e-mail.

2. Registration

2.1 Any user who wishes to benefit from the services of the community must register before participating. In doing so, he must submit the data requested in the registration form, which he then has to keep up to date for the duration of his registration.

2.2 The registration is confirmed to the user by e-mail. There is no legal claim to registration. The operator is entitled to refuse the registration without giving reasons.

2.3 The user must correctly fill in all fields marked as mandatory fields when registering. Pseudonyms are also not allowed, such as a non-existent e-mail address or an e-mail address belonging to a third party. If the specified data changes after logging in, the user himself is obliged to correct the information in his member account immediately. Multiple registration is not permitted.

2.4 SITE GAME.AT reserves the right to refuse registration without stating any reasons. All user information recorded by the operator will be deleted within 5 working days.

2.5 The operator reserves the right to delete user accounts of incomplete applications after a reasonable time.

3. Password and duties of the user

3.1 By registering each user chooses an individual password. Access to the services in the community is only possible with this password.

3.2 If the password is lost or if a reasonable suspicion that a third party gains knowledge of the password, the user is obliged to change the password immediately and to inform the administrators of the community by e-mail in writing.

3.3 Until the misuse is reported, all statements and content submitted to the user are attributed to the user. The user is liable until then for any misuse of third parties, unless he is not at fault.

3.4 The user has to check all texts for content correctness. The user agrees to comply with the statutory provisions.

3.5 The User shall not post any content or contributions that violate the rights of third parties (in particular naming rights, personal rights, trademark rights, copyrights, ancillary copyrights, etc.) that are illegal, unsuitable, offensive or objectionable to minors, the viruses, bypass devices or unsolicited mass mailings (so-called "spam") requesting participation in chain mail, pyramid play and bonus shares or for commercial or other promotional purposes. The user has to observe existing copyright and industrial property rights of third parties and criminal provisions.

3.6 The following contents are not permitted and may not be set by the user:

- unlawful / punishable content

- slanderous content

- violent ideas

- Contents related to substance abuse

- Idea with a radical political or religious view.

If business-damaging content is discontinued, the operator is entitled to delete it and to prohibit the user from further posting in the community.

3.7 The user is solely responsible for all data and information that he disseminates through the community and passes it on to others. If the option to specify so-called hyperlinks (hereinafter referred to as "links") is given, the user undertakes to check the links he has set for unlawful, racist, slanderous, threatening or radical-political content and links with such content to delete.

3.8 It is not permitted to keep more than one user access in the community, even if a user has different e-mail addresses.

3.9 It is also not permitted to use machines, algorithms or other automatic functions to generate page views or content.

3.10 SIDE GAME.AT reserves the right to report any violations of applicable law to the authorities of the user's country. Furthermore, the operator reserves the right to claim damages for violations of the GTC.

4. Rights granted by the user

4.1 The User assigns to the Operator a royalty-free, unlimited, extensive right of use, in particular for duplication, distribution, processing of all works or parts of the work that the User transmits to ONE2.ONE within the Community, including the right to use this content in print media , online, on CD-ROMvetc. to publish, also for advertising purposes. The right of use includes only those uses that are necessary to fulfill the contractual obligations of the operator. The user reserves the right to object to individual uses.

4.2 By setting texts, images, image sequences and labels, the user declares that he is the owner of all rights to the text, images, image sequences and marks provided.

4.3 The granted rights cease with the termination of the membership or the removal of the information on the part of the user

5. Deletion of the registration

Each user can have their registration deleted at any time. With the deletion of the registration the eligibility for registration no longer applies. The operator is entitled to delete an existing registration without giving reasons, and will do so in particular if the user has made false information during registration or violates the terms of use. A deletion of the registration will be communicated to the respective user by the community in writing, by e-mail. In the case of deletion of the registration, there are no claims against the operator, in particular not for deletion of user contributions in the community or on the platform.

6. Liability

6.1 SEITENSPIEL.AT is liable only in cases in which the self, a legal representative or a vicarious agent intent or gross negligence to the load falls. The above does not apply insofar as liability for damages arising from injury to life, limb or health, as well as in the case of a breach of essential contractual obligations. Except in the case of intent, gross negligence and damage resulting from injury to the life of the body or the health, the liability is limited in height to the typically foreseeable damages.

6.2 For damage resulting from the use of provided information, in particular through the use of the community, the user alone is liable as the provider of this information.

6.3 The user is basically liable for all activities that are carried out using his member account. If the user is not responsible for the misuse of his membership account because there is no violation of existing due diligence obligations, then the user is not liable.

7. Haftungsfreistellung

Der User stellt SEITENSPIEL.AT von sämtlichen Ansprüchen frei, die andere User oder sonstige Dritte dem Betreiber gegenüber geltend machen wegen Verletzung ihrer Rechte durch von dem User eingestellte Inhalte oder wegen dessen sonstiger Nutzung der Community. Der User trägt die hierfür entstandenen Kosten der notwendigen Rechtsverteidigung von SEITENSPIEL.AT einschließlich sämtlicher Gerichts- und Anwaltskosten in gesetzlicher Höhe.

Dies gilt nicht, wenn die Rechtsverletzung von dem User nicht zu vertreten ist. Der User ist verpflichtet, dem Betreiber für den Fall einer Inanspruchnahme durch Dritte unverzüglich, wahrheitsgemäß und vollständig alle Informationen zur Verfügung zu stellen, die für die Prüfung der Ansprüche und eine Verteidigung erforderlich sind.

8.Warranty

SITE GAME.AT can not assume any warranty for technical defects, in particular for the constant and uninterrupted availability of the database and its contents or for the complete and error-free reproduction of the contributions provided by the user.

The services in the community are offered by the operator free of charge and without obligation, without any legal obligations to maintain the operation. The operator reserves the right to discontinue or charge the community in whole or in part at any time without prior notice.

9. External links and viruses

9.1 The operator has no influence on the content of external links; This is the responsibility of the operator exclusively. The operator expressly dissociates itself from all contents of external links and assumes no liability for their content.

9.2 The user is responsible for ensuring that the files transmitted by him are virus-free. The operator reserves the right to assert compensation claims against the user due to virus-related damages.

10. Privacy

The user is informed about the type, scope, location and purpose of the collection, processing and use of personal data required for the registration of MODELTOWN.ORG and the conduct of business by the operator (see Privacy Policy).

The user is aware that in order to optimize the community, the operator stores all the pages visited and the duration of each call. Further, the user is aware that personal information such as e-mail address is displayed in the community when registering. SITE GAME.AT is entitled to communicate with the user electronically or otherwise, and the user hereby agrees to such communication.

11. Final provisions

11.1 The contract language is German.

11.2 Contracts between the operator and the user shall be governed by the law of the Republic of Austria, excluding the laws governing the international sale of movable goods. This choice of law applies to consumers only insofar as the protection afforded by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn from the customer.

11.3 If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the seller is the seller's domicile. This also applies if the customer does not have a general place of jurisdiction in Austria or the EU, or his domicile or habitual residence is not known at the time the complaint is filed.
